Trial date set for Boshey hit-and-run death case

REGIONAL — A federal jury trial date has been set for March 16 in the case involving the December 2024 hit-and-run that killed 38-year-old Amanda Boshey near Fortune Bay Resort Casino.
Eric Scott Peterson, of Virginia, is charged with two felony counts of criminal vehicular homicide, one for operating a motor vehicle while under the influence of alcohol and another for having a blood alcohol content greater than 0.08.
Investigators used surveillance footage from Fortune Bay and the nearby Y-Store to identify Peterson as the owner of the truck believed to have struck Boshey.
Peterson was initially charged under federal involuntary manslaughter statutes. Prosecutors later invoked a provision allowing them to bring charges under Minnesota law instead.
U.S. District Judge Laura M. Provinzino met Oct. 16 with Assistant U.S. Attorney Nichole Carter and defense attorney Jean Brandl for a status conference in the case.
The parties agreed to set the March trial date.
Provinzino also granted an oral motion to exclude the time between Oct. 24 and the start of trial from the calculations used to determine Peterson’s right to a speedy trial under federal law.
Under the federal Speedy Trial Act, a criminal case must generally proceed to trial within 70 days of a defendant’s indictment or first court appearance.
That clock can be stopped for specific reasons, such as motions, hearings, or continuances granted in the interest of justice, and Peterson’s clock has been stopped multiple times with his consent. Without such exclusions, Peterson’s trial would have been required to begin by early March 2025.
